Estate Planning Article.
Estate Planning for the Chronically Ill

There are certain considerations that should be kept in mind for those with chronic illnesses.   Before addressing this issue, there should be some clarification as to the definition of "chronically ill." There are at least two definitions of chronically ill. The first is likely the most common meaning, which is an illness that a person may live with for many years. Diseases such as diabetes, cardiovascular disease, lupus, multiple sclerosis, hepatitis C and asthma are some of the more familiar chronic illnesses. Contrast that with a legal definition of chronic illness which usually means that the person is unable to perform at least two activities of daily living such as eating, toileting, transferring, bathing and dressing, or requires considerable supervision to protect from crisis relating to health and safety due to severe impairment concerning mind, or having a level of disability similar to that determined by the Social Security Administration for disability benefits. Having said all of that, the estate planning such a person may undertake will likely be similar to that of a healthy person, but there will likely be a higher sense of urgency and it will be much more "real" and less "hypothetical."
Most healthy individuals view the estate planning they establish as not having any applicability for years, perhaps even decades. Whereas a chronically ill person more acutely appreciates that the planning he or she does will have real consequences in his or her life and the life of loved ones. Some of the most important planning will center around who the person appoints as his or her health care decision maker and also who is appointed to handle financial affairs. A will and/or revocable living trust will play a central role in the person's planning as well.  Care should also be taken to address possible Medicaid planning benefits.  A consultation with an estate planning and elder law attorney is critical to ensuring all necessary planning steps are contemplated and eventually implemented.

If a customer ask for an Apostille?

As a Notary Public in California you follow the rules of notarization, (California Notary Handbook).

Some notarized documents will be used in other countries. Most countries are members or have signed the Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents.

So if you customer ask you for an Apostille, you can give them the website http://CaliforniaApostille.US or tell them to call 707-992-5551

English or Spanish.

_____________________________________________________________________________

postille is the  legalization of documents originated in this state to use outside United States by a certificate giving a legal status in the countries of the Hague Convention.

Examples of the type of documents that can be apostilled: Power of attorney, certificates of birth, marriage, death, divorce decree, diplomas, transcripts, any notarized documents in california or signed the states officials as mentioned in the California state pages:
The California Secretary of State provides authentication of public official signatures on documents to be used outside the United States of America. The country of destination determines whether the authentication is an Apostille or Certification.

Apostilles and Certifications only certify to the authenticity of the signature of the official who signed the document, the capacity in which that official acted, and when appropriate, the identity of the seal or stamp which the document bears. The Apostille or Certification does not validate the contents of the document.

So documents we will be able to Apostille: by notaries and the following public officials and their deputies: County Clerks or Recorders, Court Administrators of the Superior Court, Executive Clerks of the Superior Court, Officers whose authority is not limited to any particular county, Executive Officers of the Superior Court, Judges of the Superior Court
State Officials.

If you have an emergency and need the documents legalize as soon as possible: We process them the same day that we receive your documents. Once apostilled we can send them same day Fedex Priority so you will have them the following day.
